# Forced Continuity

> A dark pattern in which a free trial or introductory period turns into a paid subscription without a clear reminder or an easy way to stop it first.

Forced continuity is a free trial or introductory price that turns into a full-price subscription without a clear warning. The card was taken at signup, no reminder arrives, and the first sign that the trial has ended is the charge.

It is the subscription member of the [deceptive design](https://www.themasterly.com/glossary/dark-patterns) family, filed in current catalogues as [hidden subscription](https://deceptive.design/types/hidden-subscription/). It often travels with a [roach motel](https://www.themasterly.com/glossary/roach-motel), since a surprise charge is worse when it is also hard to stop.

## What it looks like in SaaS

- **Silent conversion.** A fourteen-day card-required trial that charges on day fifteen with no email beforehand.
- **Trial end hidden in the product.** No banner, no date in billing settings, nothing until the invoice.
- **Conversion to the top tier.** The trial ran on the highest plan, and it converts to that plan rather than the one the team actually needs.
- **Monthly trial, annual charge.** The trial converts to an annual plan by default, charging twelve months at once.
- **Silent annual renewals.** No notice before a large annual renewal goes through.
- **Introductory pricing that quietly ends.** The discounted first three months roll into full price with no notice.

## Honest trial against forced continuity

| | Honest | Forced continuity |
|---|---|---|
| At signup | Date, plan and price of the first charge stated | "Free for 14 days" and nothing else |
| During trial | End date visible in the product | No indication |
| Before charge | Reminder with date, amount and how to cancel | Nothing |
| Plan it converts to | The one the person chose | The most expensive, or annual |
| Stopping | One click in settings | Support ticket |

## Why teams ship it

Trial-to-paid is one of the most watched numbers in SaaS, and silent conversion raises it directly. Every person who forgot to cancel counts as a conversion. Reminders feel like they invite cancellation, so they get delayed, softened or left out.

## Why it backfires

**It inflates the wrong number.** Someone charged by surprise has not decided to pay. Many ask for a refund, dispute the charge or cancel at once, so the gain in trial-to-paid reappears as a loss in month-two [retention](https://www.themasterly.com/glossary/retention).

**It costs more to handle.** Refund requests and chargebacks take support and finance time, and payment providers watch dispute rates.

**It poisons the relationship.** In B2B, a surprise charge on a company card lands with finance, who now see your company as a vendor to watch.

**It is the subject of law.** In the US, the [Restore Online Shoppers' Confidence Act](https://www.law.cornell.edu/uscode/text/15/8403) makes it unlawful to charge for goods or services sold online through a negative option feature unless the seller clearly discloses material terms before obtaining billing information, obtains express informed consent before charging, and provides simple mechanisms to stop recurring charges. The FTC's 2024 amendments to its Negative Option Rule, known as click-to-cancel, were vacated by the Eighth Circuit in July 2025; in March 2026 the FTC [sought comment on a new rulemaking](https://www.ftc.gov/news-events/news/press-releases/2026/03/ftc-seeks-public-comment-response-advance-notice-proposed-rulemaking-regarding-negative-option). The status may have moved since, and scope depends on who the buyer is.

## The honest alternative

**State the terms at signup.** "Your trial ends on 14 March. You will then be charged $60 a month for the Team plan unless you cancel." Next to the card field, in normal type.

**Show the date in the product.** A quiet trial indicator with the end date and a link to billing.

**Send a reminder before the charge.** Several days ahead, with the date, the amount, the plan and a direct link to cancel or change plan.

**Convert to what the team needs.** Let the person choose the plan during the trial, and default to the one that matches their usage rather than the highest tier.

**Notice large renewals.** Annual renewals deserve a reminder too, with time to adjust seats.

**Consider a no-card trial.** It lowers trial-to-paid as a percentage, and every conversion is a decision.

## In practice

A product runs a card-required trial on the top plan that converts automatically. Trial-to-paid is strong. So are refund requests in the first week of paid, and month-two churn is the worst in the funnel.

The team adds the charge date and amount next to the card field, a trial indicator in the app header from day ten, and a reminder email three days before conversion with a plan picker. The trial now converts to the plan picked, defaulting to the one matching current usage.

Trial-to-paid falls by a few points. Refund requests nearly disappear, month-two churn improves, and [activation](https://www.themasterly.com/glossary/activation) work gets the credit it deserves, because the conversions that remain are real.

## Where teams get it wrong

- **Measuring only trial-to-paid.** The refunds are in another report.
- **Reminders on the day of the charge.** Too late to act on.
- **Converting to the most expensive plan.** A surprise inside a surprise.
- **Annual by default.** Twelve months charged without a decision.
- **Forgetting renewals.** The same pattern, one year later and larger.

## FAQ

**What is forced continuity?**

A free trial or discounted introductory period that silently turns into a full-price paid subscription. The card was collected at signup, no reminder arrives before the first charge, and the first sign that the trial has ended is a bank statement. Current catalogues file it under hidden subscription.

**Is asking for a card at trial signup a dark pattern?**

Not on its own. Card-required trials are a legitimate model that filters for intent. It becomes forced continuity when the conversion terms are unclear at signup, no reminder is sent before the charge, or stopping the trial is hard.

**How far in advance should a trial reminder go out?**

Early enough for someone to act on it during a normal working week, which in practice means several days before the charge rather than the morning of it. The reminder should state the date, the amount and how to cancel, and the same information should be visible in the product.

**What does the law say about trials that convert to paid?**

In the US, ROSCA requires online sellers using negative option features to disclose material terms before taking billing details, get express informed consent before charging, and provide a simple way to stop recurring charges. The FTC's broader 2024 click-to-cancel amendments were vacated by the Eighth Circuit in July 2025, and the agency reopened the rulemaking in 2026. Check current status before relying on any of it.

**Does forced continuity improve trial conversion?**

It improves the first charge. It does little for the second, because people charged by surprise ask for refunds, dispute the payment or cancel immediately. Trial-to-paid looks better and month-two retention looks worse.
